This privacy policy describes how the personally identifiable information you may provide on the Sableshots.com website and any of its related products and services is collected, protected and used. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is a legally binding agreement between you and Sable Shots Photography. By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Sable Shots Photography may need to collect and use certain Personal Information. If the information is not provided, we may not be able to provide you with the requested products or services (Location address, Email, Clients first name and last, Email). The information we collect from you will be used for the following purposes: Fulfill and manage orders, deliver products or services, respond to inquiries and offer support, run and operate the Website and Services, invoicing. Sable Shots Photography are the owners of the information collected on this site. We will not sell or rent this information to anyone including any third party not within our organization that is not required for billing purposes. The only information we collect is voluntarily given to Sable Shots Photography via contact form, phone, email or other direct contact from you. 

This website uses "cookies" to help personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. We may use cookies to collect, store, and track information for statistical purpose to operate the Website and services. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. 

Copyright: Sable Shots Photography is the copyright holder of the images. The copyright of an image is not transferred to any other party unless a specific written agreement is made.

Photo Rights and Usage for Real Estate Photography: We retain the copyrights as is standard practice in the photography industry. You purchase a single use, non-transferable, non-exclusive image license. The original agent who paid for this service has permission to use these images on any electronic or printed form of advertisement for the promotion of that property. This is a non-transferable license, meaning you, as the licensee, may not sell, give or loan the photos to any other party. You do have wide leverage to use them for your marketing and promotional needs however.  This license is also non-exclusive, meaning the copyright holder may sell multiple licenses for the same images. The photos may also be used by the Client?s parent company for the sole purpose of marketing the specific property photographed.

Images cannot be sold to another agent who takes over an expired or withdrawn listing. Failure to pay for the images will result in a copyright infringement/violation. You will be asked to remove the image from any electronic or printed form of advertisement. Failure to stop using them will result in legal action.

Builders, stagers, designers and others who wish to use images taken by Sable Shots Photography should contact us for specific licensing information.

Payment: All agreed upon fees and expenses are due within 10 days of receiving the images. Sable Shots Photography reserves the right to cancel, postpone, or refuse to schedule subsequent photo shoots until account is made current.

Relationship of the Parties: Sable Shots Photography is an independent contractor, and shall not be deemed to be an employee of the Client. No agency, partnership, joint venture, or employee-employer relationship is intended or created by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. 

Copyright: Sable Shots Photography retains the copyright to all images. The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. You are granted permission by Sable Shots Photography to reproduce the images and make an unlimited number of prints, for personal use only. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the original files releases Sable Shots Photography from any liability due to loss or damage of the images, and also releases Sable Shots Photography from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to Sable Shots Photography the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use. Sable Shots Photography retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms. 

Limit of Liability: In the unlikely event that the assigned photographer from Sable Shots Photography is unable to perform to the guidelines of this contract due to an injury, illness, force majeure, internet disturbance, act of terrorism, or other cause beyond the control of Sable Shots Photography. Sable Shots Photography will make every effort to secure a replacement when applicable. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event(s) if client has already paid.

in the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond Sable Shots Photography?s control, including but not limited to camera, hard drive, or equipment malfunction, Sable Shots Photography?s liability is limited to the return of all payments received for the event(s) if received before serviced are provided. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of the originals. Sable Shots Photography is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package.

Capture and Delivery: Sable Shots Photography is not required to deliver every image taken at the event. The determination of images delivered to the CLIENT is left to the discretion of Sable Shots Photography.

Post Production and Editing: The final post production and editing styles, effects, and overall look of the images are left to the discretion of Sable Shots Photography.

Travel Fee: A travel fee of $0.75/mile will be charged if the event(s) location is further than 20 miles from Sable Shots Photography. 

Safety: The crew reserves the right to terminate coverage and depart the event(s) if the crew experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the event(s); or in the event that the safety of the crew is in question. 

Event Schedule: The client agrees to confirm the schedule prior to the event(s).  The client will be notified via text message to reply and confirm the scheduled date. The client is responsible to notify Sable Shots of any changes in schedule 24 hours in advance. A confirmation receipt of the cancellation will be sent in an email and text message.

Shooting Time/Additions: The Client and the Photographer agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time specified. If weather does not permit, Sable Shots Photography will work with the client to find a suitable time to reschedule the event(s).  The client is not required to be present at the time of the appointment unless necessary and specified. If the client is not required to be present, the client is responsible for providing appropriate access to the event(s) location. If required to be present and the Client fails to arrive within 20 minutes of the scheduled time, the shoot will be cancelled, will need to be rescheduled and a 20% fee will be billed to the client.  

Permits: The Client is responsible for acquiring all permits and necessary permission for all locations on which the Photographer will be performing services.
